Terms of Service

These Terms of Service ("Terms") govern your access to and use of LLMods ("we," "us," "our"), an AI-powered Discord moderation service. By creating an account, subscribing to a plan, or using the Service, you agree to be bound by these Terms.

Important: If you do not agree to these Terms, do not use the Service. Continued use after changes to these Terms constitutes acceptance of the updated Terms.

1. Service Description

LLMods provides AI-powered content moderation for Discord servers ("guilds"). Our Service includes:

• LLMods Starter: Real-time message scanning, policy enforcement, automated warnings, and moderation notifications (pricing shown on the website and at checkout; up to 2 Discord servers on Starter).
• LLMods Pro: All Starter features plus Steward (conversational server setup) and Analytics. Pricing and server limits are shown on the website and at checkout (up to 5 Discord servers on Pro).
• Hosted judgments: Use our managed model infrastructure. Prepaid top-ups and optional auto-charge overage are available in Billing; amounts and judgment grants are shown before you confirm.
• Your API key: Use your own LLM provider key for judgments (no per-judgment charges from LLMods; you pay your provider).

The Service uses large language models (LLMs) to analyze message content against your moderation policies. Moderation decisions are based on AI judgments and are not guaranteed to be accurate. LLMods assists your team; you remain responsible for moderation outcomes. Human review is recommended for high-stakes decisions.

2. Account Registration and Eligibility

• You must be at least 13 years old to use the Service (or the minimum age required in your jurisdiction).
• You must provide accurate, complete account information and keep it up to date.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account or allow others to access the Service using your credentials.
• One account per person. Multiple accounts for abuse or circumvention are prohibited.

3. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Abuse, harass, threaten, or harm others.
• Distribute spam, malware, or malicious content.
• Circumvent usage limits, rate limits, or billing systems.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to train competing AI models or moderation systems without our written consent.
• Operate the Service in a way that disrupts or degrades the experience for other users.

We reserve the right to suspend or terminate accounts that violate this policy.

4. Subscriptions and Billing

4.1 Subscription Plans

Subscriptions are billed monthly. Current plan prices, included welcome judgments (if any), and top-up offers are shown in the product and at checkout. We may change prices with notice as described below; the price you confirm at checkout is the price you pay for that purchase.

• Starter: One Discord server. Hosted or your API key path.
• Pro: Up to 5 Discord servers, plus Steward and Analytics. Hosted or your API key path.

Judgments granted with a new Hosted subscription are a one-time welcome credit, not a recurring monthly allowance. They are granted when your subscription first begins and are not re-granted on renewal.

4.2 Hosted Judgments

• Hosted plans may purchase prepaid judgment credit top-ups. The amount you pay and the judgments you receive are shown in Billing before you confirm.
• Auto-charge OFF (default): When your prepaid judgment balance reaches zero, Hosted moderation pauses until you top up or enable auto-charge.
• Auto-charge ON: Judgments beyond your prepaid balance may be metered and billed on your next cycle at the overage rate shown in Billing.
• Your API key plans do not incur LLMods per-judgment fees; you pay your own LLM provider.

4.3 Payment and Renewals

• Subscriptions renew automatically each month unless canceled.
• Payment is processed via Stripe. By subscribing, you authorize recurring charges.
• When auto-charge is enabled, Hosted judgment overage is metered and billed via Stripe.
• Failed payments may result in service suspension until payment is resolved.
• You can upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle, with prorated adjustments.

4.4 Cancellation

• You may cancel your subscription at any time from the Billing page.
• Cancellations take effect at the end of your current billing period.
• No refunds are provided for partial billing periods or unused subscription time.
• Hosted judgment fees are non-refundable once judgments are consumed.

5. Fair Use and Abuse Limits

To ensure service quality for all users, we enforce fair-use limits on Hosted judgments:

• Excessive or abusive API usage may result in rate limiting or throttling.
• Automated spam or repeated identical messages may be flagged and blocked.
• Users with their own API key must comply with their LLM provider's terms of service and usage limits.

We reserve the right to investigate and address accounts that exhibit abusive usage patterns, including temporary suspension or account termination.

6. Refund Policy

• Subscription fees: Non-refundable. Cancellations take effect at the end of the billing period; no prorated refunds for early cancellation.
• Hosted judgments: Non-refundable once consumed. Prepaid judgment balances remain available until used or your account is closed, subject to these Terms.
• Extenuating circumstances: Refund requests due to service outages, billing errors, or other issues may be reviewed on a case-by-case basis. Contact support with details.

7. Service Availability and Warranties

AS-IS SERVICE: LLMods is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Accuracy or reliability of AI moderation decisions
• Uninterrupted, error-free, or secure operation
• Fitness for a particular purpose or merchantability

We do not guarantee that the Service will detect all policy violations or prevent all harmful content. Human review is recommended for high-stakes moderation decisions.

We work to keep the Service available, but we do not offer a service-level agreement or uptime guarantee. We are not liable for downtime, data loss, or interruptions caused by third-party providers (Discord, Stripe, LLM providers) or events beyond our reasonable control.

8. Limitation of Liability

To the fullest extent permitted by law:

• LLMods and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.
• We are not responsible for moderation decisions made by the AI, user-generated policies, or Discord server management actions.

9. Indemnification

You agree to indemnify, defend, and hold harmless LLMods and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms or applicable laws
• Your moderation policies or actions taken against Discord users
• Disputes with third parties related to your use of the Service

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment or fraudulent billing activity
• Abuse or misuse of the Service
• Legal or regulatory requirements

Upon termination, your access to the Service will cease, and any outstanding fees will become immediately due. We are not liable for any damages resulting from termination.

You may terminate your account at any time by deleting your account from the Account Settings page.

11. Intellectual Property

LLMods and its original content, features, and functionality are owned by LLMods and its licensors and are protected by copyright, trademark, and other intellectual property laws.

• You retain ownership of your Discord message content and moderation policies.
• By using the Service, you grant us a limited license to process and store your content as necessary to provide the Service.
• You may not copy, modify, distribute, or create derivative works from the Service without our written consent.

12. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Dispute Resolution and Governing Law

Governing law, venue, and dispute resolution procedures will be stated here once finalized with legal counsel. Until then, mandatory consumer protections in your place of residence continue to apply where required by law.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated via email or in-app notification.

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription.
